When you import recipes from external sources (such as TikTok, Instagram, YouTube, or websites), we process the content you provide but do not access your accounts on those platforms.

We retain your personal information for as long as your account is active or as needed to provide services. You may delete your account at any time, after which we will delete or anonymize your data within 30 days, except where retention is required by law.

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect and how it is used, and the right to request deletion of your personal information.

1. Acceptance of Terms

By downloading, installing, accessing, or using PureYumE, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and PureYumE, operated from Crestview, Okaloosa County, Florida.

2. Description of Service

PureYumE is a mobile application that helps users:

• Import and save recipes from various sources including social media, websites, and manual entry
• Manage a virtual pantry of available ingredients
• Match recipes with on-hand ingredients
• Generate smart grocery lists
• Plan meals and follow guided cooking instructions

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent.

4. Subscription and Payments

4.1 Free and Premium Tiers

PureYumE offers a free tier with limited features and premium subscription plans with enhanced functionality.

4.2 Billing

Subscriptions are billed through the Apple App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases. Subscription fees are charged at the beginning of each billing period.

4.3 Automatic Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple ID account settings.

4.4 Refunds

Refund requests are handled by Apple according to their refund policies. We do not directly process refunds for App Store purchases.

4.5 Price Changes

We reserve the right to modify subscription pricing. Existing subscribers will be notified in advance of any price increases affecting their current subscription.

5. User Content

5.1 Your Content

You retain ownership of recipes, notes, and other content you create or upload ("User Content"). By using the App, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of providing the service.

5.2 Content Restrictions

You agree not to upload or share content that:

• Infringes intellectual property rights of others
• Contains malicious code or harmful content
• Violates any applicable laws or regulations
• Is fraudulent, deceptive, or misleading

5.3 Third-Party Content

When importing recipes from external sources, you are responsible for ensuring you have the right to use that content. We are not responsible for the accuracy, legality, or appropriateness of third-party content.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to access the App without permission
• Share your account credentials with others
• Misrepresent your identity or affiliation

7. Intellectual Property

The App, including its design, features, code, graphics, and content (excluding User Content), is owned by PureYumE and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Disclaimers

8.1 Service Availability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee uninterrupted or error-free service.

8.2 Recipe and Nutritional Information

Recipe information, including ingredients, cooking instructions, and nutritional data, is provided for informational purposes only. We do not guarantee accuracy and are not responsible for adverse reactions, food allergies, or health issues. Always verify ingredients and consult appropriate professionals for dietary concerns.

8.3 AI-Generated Content

Some features use artificial intelligence to process and suggest recipes. AI-generated content may contain errors or inaccuracies. Users should verify all information before relying on it.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUREYUME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless PureYumE, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Okaloosa County, Florida.

14. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us through the form below. If we cannot resolve the dispute within 30 days, either party may proceed with formal legal action.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PureYumE regarding your use of the App and supersede all prior agreements.
